Terms of Service

These Terms of Service ("Terms") govern your use of the Génie voice assistant device, firmware, and the companion web app at app.forty2a.com (together, the "Service"), provided by forty2a ("we", "us", "our"). By creating an account, registering a device, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & accounts

You must be at least 18 years old (or the age of majority where you live) and able to enter into a binding contract to create an account. The Service is intended to be set up and managed by a parent or guardian on behalf of a child. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for activity that occurs under your account.

2. Use by children

Génie is designed for children but is administered by a parent/guardian. As the account holder you consent to your child's use of the Service, you supervise that use, and you control the child's profile, settings, and data through the web app. You are responsible for deciding what is appropriate for your child and for the device's physical safety and use.

The Service uses artificial intelligence to generate answers, stories, images, and other content in response to spoken or typed input. AI output may sometimes be inaccurate, incomplete, or unexpected despite our safety measures. It is provided for general information, learning, and entertainment, and is not professional, medical, legal, or safety advice. We encourage parental supervision and independent verification of important information. Content moderation reduces, but cannot guarantee the elimination of, all inappropriate content.

Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms. By using the Service you acknowledge that policy.

6. Availability, updates & changes

We may add, change, suspend, or discontinue features at any time, and we may update device firmware to maintain or improve the Service, including safety and security. The Service depends on internet connectivity and third-party providers and may experience interruptions. We may update these Terms; for material changes we will update the date above and provide reasonable notice. Continued use after changes means you accept them.

7. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure, or that AI output will be accurate or suitable for any particular purpose.

8. Limitation of liability

To the maximum extent permitted by law, forty2a and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from or related to your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law (such as certain consumer rights). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

9. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate access if you violate these Terms, to protect users (especially children) or the Service, or as required by law. Provisions that by their nature should survive termination (such as disclaimers and limitations of liability) will survive.

10. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules, except where mandatory local consumer-protection law applies to you. The courts located in Ontario, Canada will have jurisdiction, subject to any non-waivable rights you have under local law.
